Hire a general contractor in Mallorca when the work is clearly defined, you want one contract and one point of contact, and you or someone you trust can see the site regularly. Hire an architect or design studio to plan the work, tender it and supervise the builders on your behalf when the house still has open questions, you live abroad, or design and control matter to you. The two can be combined: the architect plans and supervises, and a single building firm carries out all the work to the architect’s specification.
What Spanish law requires either way
Hiring a general contractor does not change your obligations under Spain’s building act, the Ley de Ordenación de la Edificación (LOE). If the work needs a project, for example because it touches the structure, changes the volume or use of the building, or amounts to a full renovation, an architect must write the project for a residential building and direct the works. An arquitecto técnico, usually called the aparejador, directs the construction itself. Together they form the dirección facultativa. The procedure is explained in our article on building permits on Mallorca.
Simple work without a project, such as new floors or a bathroom that keeps its layout, only needs a notice to the town hall, the comunicación previa, and no architect is required. For anything larger, the real question is a different one: does the architect work for you or for the building firm?
How a general contractor works in Mallorca
A general contractor, in Spanish contratista general or empresa constructora, takes on all the work for one price and passes parts of it to subcontractors such as electricians or joiners. Many firms on the island offer turnkey renovations, llave en mano, and bring their own architect and aparejador for projects that need a permit.
The appeal is simplicity: one contract, one invoice and one firm responsible for the whole job, which under the LOE includes its subcontractors’ work. For clearly defined work, say a kitchen and bathroom in an apartment in good condition, that is often a sensible route, especially if you live on the island. The drawback is that the firm largely checks itself, the architect it brings is part of its offer, and with a single quote there is nothing to compare.
How the architect-led model works
In the second model you appoint the architect or design studio directly. They plan the work, write a specification with quantities, materials and construction details, collect quotes against it and compare them. You sign the contracts yourself with the firms doing the work, either with several trades or with one building firm for everything. On site, the architect’s team represents you towards the builders: they check that what is built matches the drawings and that invoices match the work done.
This adds a fee on top of the building costs. In return you get quotes on the same basis, a clear line between agreed work and extras, and someone on site who prepares decisions for you. Quotes in Mallorca are often brief and rely more on verbal agreements, so if you do not live on the island you need a written basis and someone who looks on your behalf, as described in renovating in Mallorca from abroad.
What each model means for cost and risk
A fixed price is only as fixed as the description behind it. Under Article 1593 of the Spanish Civil Code, a firm building for a lump sum cannot raise the price because wages or materials went up, unless the contract provides otherwise. It can charge more if the project changes and you approved the change. If a quote says “bathroom complete”, nobody knows what is included, and every question settled on site can become a change.
For defects, the LOE applies under both models once the work needs a project. From handover, the parties involved are liable for ten years for structural defects and three years for defects affecting habitability, and the builder is liable for one year for defects in finishes. With a general contractor you take everything to one firm. With separate contracts each firm answers for its own part, and if the cause cannot be attributed to one of them, they are jointly liable.
The biggest risk is the same in both cases: nobody checking whether what was agreed is delivered. With a general contractor it is concentrated, and if the firm falls behind, the whole site stops. With separate contracts it sits where one trade hands over to the next, and site management has to set that sequence.
Questions to ask before you sign
- Which drawings or specification is the quote based on, is it itemised with quantities, and what is explicitly excluded?
- Who are the architect and the aparejador, and who appointed them?
- How are changes priced, and do they need your written approval before work starts?
- Do payments follow verified progress on site, and is a retention held back until defects are fixed?
- Which subcontractors will work on the house, and who is your contact on site, in which language?
How to spot gaps in a quote is covered in Red flags in contractor quotes.
How CARLO Design works in Mallorca
CARLO Design is a studio for architecture, interior design and construction management in Palma. We are not a building firm. We first check what can be permitted and prepare the permit project with an architect registered with the Colegio, with whom we have worked for years. On site we work with aparejadores and the authorities.
For the construction we write a specification, ask suitable firms to quote, and check the quotes for completeness before we compare totals. You decide on the basis of our recommendation and sign the contract directly with the firm, including a payment schedule tied to progress. During the works we are on site every week, check the work against the drawings, review extras and invoices, and send you reports with photos, in English, German or Spanish.
Our fee comes on top of the building costs: planning is 10 to 15 percent of the construction cost, and project management and site supervision are charged on top depending on scope and duration. Most of our residential projects in Mallorca come in at €1,200 to €2,500 per square metre. More on our project management on Mallorca and building contractors on Mallorca pages.
FAQ
Do I still need an architect if I hire a general contractor in Mallorca?
Yes, as soon as the work needs a project, for example when it touches the structure, changes the volume or use of the building, or amounts to a full renovation. For residential buildings, Spanish building law (the LOE) then requires an architect for the project and site direction and an arquitecto técnico (aparejador) to direct the construction work. Many general contractors bring both. Simple work that only needs a comunicación previa does not legally require an architect.
Is a fixed price from a general contractor really fixed?
It covers the work described in the contract. Under Article 1593 of the Spanish Civil Code, a firm working for a lump sum cannot raise the price because wages or materials became more expensive, unless the contract says otherwise. It can charge for changes you have approved. The vaguer the description, the more turns into a change once work starts.
Who is liable for building defects in Spain?
For works that need a project, Article 17 of the LOE sets the periods, counted from handover: ten years for structural defects, three years for defects affecting habitability, and one year for the builder’s liability for defects in finishes. A general contractor is also directly liable for the work of its subcontractors. If the cause cannot be attributed to one party, all parties involved are jointly liable.
Is a general contractor cheaper than hiring trades separately?
Not necessarily. A general contractor builds coordination and risk into its price, while the architect-led model adds a fee for design and site management. Which ends up cheaper depends mostly on how precisely the work is described and how many extras come up during the build.
Can I combine both models?
Yes. An architect or design studio plans and tenders the work, and a single building firm carries it out based on that specification. You sign one building contract and still have someone checking quality, extras and invoices on your behalf. This is a route CARLO Design offers in Mallorca.
